1. Who We Work With

We serve, but not limited to, service based businesses, fitness, health, wellness, and medical-adjacent professionals. By using our services, you confirm that:

• You are at least 18 years old
• You are authorized to act on behalf of your business or organization
• You will use our services legally and responsibly

2. Services We Provide

We offer CRM software, client automation workflows, marketing support, and business consulting services.

Service features may include, but not limited to:

• Custom lead workflows
• SMS/email automation
• KPI tracking and reporting
• Staff onboarding and training

We reserve the right to modify, pause, or discontinue services at any time, with or without notice.

3. Your Responsibilities

You agree to:

• Provide accurate business and contact information
• Use our services in compliance with all applicable laws (including HIPAA if applicable)
• Maintain the confidentiality of your login credentials
• Not reverse-engineer, copy, resell, or misuse our intellectual property or systems

4. Payment & Subscription

• Our services may require a monthly or annual subscription.
• All payments are non-refundable unless stated otherwise in writing.
• Late payments may result in service suspension or termination.

5. Intellectual Property

All content, systems, workflows, and templates created by or for Elevated by Dragonflies LLC, dba Elevate with Nuvana, are owned by us. Clients may not reuse, sell, or share these assets outside their own business without written permission.

6. Termination

You may cancel your services at any time with a 30 day written notice. We reserve the right to terminate or suspend your access to our platform if:

• You breach these Terms
• Payment fails
• Misuse or abuse of services occurs

7. Limitation of Liability

We do our best to keep things running smoothly, but:

• We are not liable for business losses, missed leads, or indirect damages
• Our services are provided "as-is" without warranties of any kind
• Use our tools responsibly and keep a backup of your data.

8. Privacy

Our use of your personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference.

No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. Information sharing to subcontractors in support services, such as customer service is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

9. SMS Messaging Terms

By opting in to SMS communications from Elevated by Dragonflies LLC, dba Elevate with Nuvana, you agree to receive text messages related to your interactions with us. Message frequency varies. Message and data rates may apply.

You may cancel SMS messages at any time by replying STOP. You will receive a confirmation of your opt-out. To receive messages again, you must opt in again. For assistance, reply HELP or contact support@elevatewithnuvana.com or (740) 570-4449. Carriers are not liable for delayed or undelivered messages.
